Defendant bound over 2nd time in child sex case

HUTCHINSON, Kan. — For the second time, a local man has been bound over for trial in a child sex case.

Kenneth Broadfoot is charged with criminal sodomy involving a 15-year-old girl. The state alleges that he engaged in sexual activity with the girl back on Sept. 12, 2015. The crime apparently occurred on the Kansas State Fairgrounds in a building the victim described as a temporary building. She also admitted at the preliminary hearing that the sexual contact was consensual and the she even initiated it, however under Kansas law, it’s still unlawful for him to have any sexual contact with a child that age.

The controversy is over a video tape that the victim in the case apparently made where she recanted that it happened, however, she admitted in court both times that it did happen, this time admitting she lied on the video tape. She had admitted she was friends with the defendant and didn’t want to get him in trouble.

The video wasn’t brought to the attention of the defense until the original preliminary hearing. During a motion hearing, Judge Tim Chambers had ordered the new preliminary hearing over the video with a new judge, but Judge McCarville basically made the same findings as Magistrate Judge Cheryl Allen in the original hearing.

Broadfoot is free on bond and will be arraigned a second time on June 6.
