HUTCHINSON, Kan. — A 32-year-old ex-con arrested at Walmart last year for allegedly being in possession of meth, possession of cocaine and drug paraphernalia, all with intent to distribute wants a dismissal of the charges citing speedy trial rules.

Jerry L. Mahan II at one time was free on a $10,000 bond and was required to have GPS monitoring, but he allegedly took the ankle bracelet off and threw it in the street where a car then ran over it, destroying it. That was in Wichita.

The state had already filed a motion to revoke the bond because he has not responded to supervision while on bond. Judge Joe McCarville set a bond of $75,000. He was arrested on Jan. 3 of this year and allegedly again had a seller’s quantity of drugs.

The first case started with Mahan sitting on a bench. He left a black case on the bench as he left. Someone found it and turned it in to customer service. They noticed that the contents didn’t look legal, so when Mahan came back to claim the case, police were called in. The case allegedly contained the meth and cocaine, both at least 3.5 grams, but less than 100 grams. That was on June 21, 2015.

When arrested on the warrant on Jan. 3, he was allegedly in possession of a seller’s amount of methamphetamine, between 3.5 and 100 grams, according to the criminal complaint. He apparently had a tag on the vehicle he was in that didn’t match the vehicle.

Charges in the second case include possession of methamphetamine with intent to sell, interference with law enforcement, theft of the tag and illegal display.

Deputy District Attorney Tom Stanton says Judge Trish Rose will scheduled a hearing over the motion.
