SOUTH HUTCHINSON, Kan. – A 70-year-old man who paroled to South Hutchinson and arrested in a domestic case earlier this summer as expected entered a plea in the case Wednesday.

Clarence Elbert Jr. was arrested on charges of aggravated assault with a deadly weapon and battery-domestic violence on June 22 after South Hutchinson Police were called to the home over a possible overdose. But, he entered a plea to the domestic battery charge and the state dropped the assault count.

Because he was convicted of a misdemeanor only, he was sentenced to six months in jail and one year probation. However, he still has the parole hold for the kidnapping and rape for a case which occurred in Sedgwick County in 1973. That means he could be sent back to prison, so he won’t be released from the jail here.

In the local case, police arrived at the home where they met the victim and she told officers that she had been battered and that Elbert had taken a large quantity of pills.

The two apparently got into a confrontation and he allegedly struck her on her head and as she tried to escape, he grabbed her by the hair and hit her in the back of the head several times causing her to fall on the floor. She says she then tried to retrieve her phone and that’s when he allegedly grabbed a butcher knife from the counter and pointed it at her telling her that if she called police, she would be dead before they arrived. He also stated that if they couldn’t be together, they would die together.

She was apparently able to get away from him after he took the pills and fell backwards on the floor.

He was also ordered to have no contact with the victim in the local case as part of the probation.
