HUTCHINSON, Kan. — A 32-year-old man who entered pleas after his arrest at Walmart last year for being in possession of meth, possession of cocaine and drug paraphernalia, all with intent to distribute, was finally sentenced Friday.

Judge Trish Rose granted three years community corrections for Jerry L. Mahan II, on a 14-year, two month sentence. The defense had sought a downward departure in the case and the state didn’t oppose that.

The case started with Mahan sitting on a bench at Walmart and left a black case on the bench as he left. Someone found it and turned it in to customer service. They noticed that the contents didn’t look legal, so when Mahan came back to claim the case, police were called in. The case allegedly contained the methamphetamine and cocaine, both at least 3.5 grams, but less than 100 grams. That was on June 21, 2015.

Mahan managed to post bond in that case, but then absconded and was eventually arrested on warrant on Jan. 3. He was then in possession of a seller’s amount of methamphetamine, between 3.5 and 100 grams resulting in the filing of charges in the second case.

He’s currently in the Kansas Department of Corrections serving a parole violation. His attorney says he should be released on that in Dec., so the corrections for these two cases will begin once released.
