A 31-year-old illegal immigrant convicted of aggravated intimidation of a witness and aggravated battery here in Hutchinson will serve time in state, despite the defense request for community corrections.

Jose C Jaquez-Gonzales apparently came upset when his live in girlfriend had gone out on a Friday night back in June and came home early the next morning around 4 a-m. The two argued and it then escalated when he reportedly put a knife to her throat and threatened to slit her throat. She ended up being stabbed in the in her right calf just above her ankle.

He’s then alleged to have forced her upstairs in the home they share in the 700 block of East A. He is also alleged to have threatened to harm her if she called police. At some point Saturday morning, he left, and after that she left and eventually went to Promise Regional Medical Center for treatment, who then called police.

Then late Saturday night, she and her mother went out looking for him and spotted a vehicle he was thought to be in at a home in the 700 block of East 6th. Police spotted a vehicle in the 400 block of East 6th, with two Hispanic men inside. Police made a felony stop, and one of the men was Jaquez-Gonzales.

In court, his attorney, Alice Osburn told the judge that there is an immigration hold on Jaquez-Gonzales and the she wanted him to be granted community corrections so he could be taken by immigration officials to possibly be deported. This is the second time he came to the U-S illegally meaning he could potentially be charged in Federal Court, but that hasn’t happened so far. Judge Tim Chambers went against the defense request and sentenced him to 24-months in state prison and said, “immigration officials can decide what they want to do with him after he’s served the sentence in state prison.
