Judge orders mental evaluation for 28-year-old charged with lewd act

HUTCHINSON, Kan. — It was just last Friday when Judge Tim Chambers ordered a mental evaluation for a 28-year-old man convicted of breaking into a home and committing sexual battery. It was part of a community corrections violation for Christopher Mayberry.

He was back in court Monday facing a new charge of lewd and lascivious behavior for exposing himself to another person on Jan. 20. While in court, Magistrate Judge Cheryl Allen was told that the state may file an additional charge.

In the earlier case, Mayberry was convicted of aggravated burglary for going into a residence in the 600 block of East 9th. Once in the home, Mayberry touched a 16-year-old for his own sexual pleasure.

Mayberry is no stranger to law enforcement, he served time in prison for drugs, criminal damage, and burglary. Those cases go back to 2007 and 2008.

The new case is on hold pending the outcome of the mental evaluation, which is expected to be announced in front of Judge Chambers this Friday.
