HUTCHINSON, Kan. — After Judge Trish Rose denied James Rodney Quinton any relief over his speedy trial arguments, he entered a plea to one count of rape. The state then dropped two counts of aggravated criminal sodomy.

Quinton, 44, managed to get his conviction and 72-year sentence overturned for two counts of aggravated criminal sodomy and rape. Judge Rose ruled that his speedy trial rights had not been violated.

Quinton’s habeas corpus motion was denied at the district court level, but reversed by the Kansas Court of Appeals. In light of the new plea, that trial won’t be necessary.

Both sides will recommend 27 years and five months in prison.

As part of the agreement, Quinton waives his right to appeal. He can never return to Reno County. He also agrees to have no contact with the victim who was in court Wednesday.

As he entered the guilty plea, Quinton told the victim twice, “I’m sorry.” He also cried.

Quinton was originally convicted of sexually assaulting a young woman at a local residence on Sept. 18, 2003.

Sentencing is set for May 11.
