One of three people suspected of being involved in a computer scam saw the case against her dismissed by Judge Tim Chambers.
Kylie Hartman has denied being involved with murder suspect Billy Craig. Jr., and Kasey Pisoni in the scam, where the three are alleged to have made or attempted to make checks using a false identification and were going to or did purchase a computer in furtherance of the conspiracy.
There had been testimony that no any were check seized or even made, In fact during the preliminary hearing, Pisoni testified that it was Billy Craig’s idea, but says it never actually happened. She says they had talked about it, but didn’t know Craig had gotten the licenses until after the fact. As for the checks, she never saw them. Police Detective Dean Harcrow testified during that same hearing that they never found them either.
Judge Chambers says he read through the transcript of the preliminary hearing a number of times and never once saw the word computer mentioned or even use of a computer. He says there were no checks and Pisoni claims it never happened, its hard to say based on what came out at the preliminary hearing that there was conspiracy. He dismissed that count.
As for the identity theft charge, the judge says there is no evidence that Pisoni discussed with with Hartman about the I-D cards, but assumed she knew about it and was involved because her picture was on one of the cards. He also dismissed that count.
Senior Assistant District Attorney Steve Maxwell informed the court that they will refile the case, and that could mean murder suspects Billy Craig Jr., and Charles Christopher Logsdon may have to testify.
The alleged plan was to use the fake licenses and the fake checks, buy merchandise at various stores around the state, then later take the merchandise back for the cash.
Pisoni was sentenced for her part in this case to 6-months for a charge of conspiracy to commit computer fraud, then granted her 12-months community corrections. She was also given another 18-months community corrections on a 22-month sentence for a conviction of being in possession of methamphetamine with intent to sell for a case that goes back to August 3, 2011.
Craig and Logsdon are charged with murder in the shooting death of Jennifer Heckel last summer.
