HUTCHINSON, Kan. — The preliminary hearing for a 43-year-old Hutchinson man charged with aggravated battery was supposed to resume Monday. Instead, Bryon McCoy waived the rest of the hearing and is expected to enter a plea early next month.

McCoy is charged with aggravated assault, possession of methamphetamine, marijuana and drug paraphernalia.

Law enforcement officers were called to Hutchinson Regional Medical Center in November after the victim reported being pistol-whipped by another man while he was at a residence near Fun Valley.

The victim testified that he went to the residence with a woman to sell a tool. She went into the home on West 4th alone while he waited in the car. After some time, she came out and told the victim that McCoy didn’t want to buy the item. He then turned the vehicle around and started to leave. At that time, the woman made advances toward him, so he stopped the vehicle and ask her to quit. It was then that McCoy showed up and hit him with the barrel of a handgun.

The arrest of McCoy led to a search of his residence, where officers reportedly found methamphetamine, marijuana and drug paraphernalia.

Judge Joe McCarville set an arraignment date of July 3.
