WICHITA – The Sedgwick County Sheriff’s Office is taking issue with a comment made on the Wichita Eagle website over the investigation of a Sedgwick County Sheriff Deputy accused of sexual misconduct with inmates in the jail

The Sheriff issued time-line information Friday that contradicts a quote from a court document on Kansas.com which says, “While it is clear that Sedgwick County was made aware of Detention Deputy Kendall’s sexual predator issues as early as April 29, 2012, no action was taken until (the male inmate) was sodomized on June 3, 2012.”

But, the sheriff says the time-line he presented to the media shows a criminal case reports was made the same day as the first allegation was made and that an investigation began immediately.

The allegation made against Deputy David Kendall says that the first incident was reported on April 29, at 5:25 a-m, and then they began their investigation. The very next day, detectives completed interviews with the exception of Kendall who was interviewed on May 1.

On May 10, they began discussion of an Assistant District Attorney over the allegation, and there were some additional re-interviews made of the first victim, JPS.

On June 3, another report of an assault is made against Kendall, that being around 3:43 a-m

The alleged second victim JT was taken from housing unit to a court holding cell. Detectives were notified 4:09 a-m, and at approximately 8:00 a-m, detectives began working the case.

As the second case developed, the assistant D-A asked investigators to present both cases to them at the at same time.

Kendall was then placed on restricted duty and no longer had any contact with inmates within the detention center. On June 15, Kendall was placed on administrative leave and FBI provided an agent to assist with the investigation, prior to Department of Justice decision to open independent investigation.

On June 18, BK makes report of assault occurring on April 13, and eventually Kendall resigned through his attorney over the allegations.

Sheriff Officials say that all allegations of wrong doing including 2-counts of aggravated criminal sodomy, 3-counts of sexual battery, 6-counts of unlawful sexual relations, and making false information.

The Sheriff, Robert Hinshaw says inmates have several methods to report allegations, including the use of a free anonymous “tip-line” from within the jail using the inmate phone system, or as happened in this case, reporting it to a detention supervisor.

The charges against Kendall are still pending.
