A 26-year-old Hutchinson man charged with 5-counts of aggravated burglary of Bill’s Appliance at 1212 West 4th, was bound over for trial after a preliminary hearing in the case Thursday.

Matthew Yohn is accused of being in the building on December 8, December 10, December December 19, of last year and again on March 16, and April 29, 2012.

He’s also charged with three counts of theft where he’s alleged to have taken coins, personal items, cash, and an amp meter. Those items taken on three separate dates including December 8th and 10th, of last year, and March 16, of this year.

He only attempted to get into the building on April 29, and that was enough for Alice Osburn, his attorney to argue that at the most, that would be attempted burglary, but Magistrate Judge Randy McEwen stated that he broke a large window which is enough to show intent.

Officer Darrin Cox took the stand at the hearing and indicated that Yohn admitted to the crimes, and that he did the break-in’s because he believed a family member got treated bad by the business.

The charges are aggravated because the appliance store is apparently connected to the owners home and she was apparently in the home asleep at the time of the burglaries.

Yohn is no stranger to the court system having served time for several burglaries going back to 2007. He had been released from prison earlier this year, and was immediately taken to the Reno County jail.

Arraignment in the case will September 4, in front of Judge Trish Rose.
