What was supposed to be a motion to suppress hearing Monday in a drug distribution case didn’t happen when Deputy District Attorney Tom Stanton told Judge Trish Rose that the case is being referred to the feds.

47-year-old Javier Reyna of 531 East Sherman was arrested after a search warrant was done at an apartment at 415 East Sherman, Apt. A. That was back on December 16, of last year.

This warrant is called an anticipatory warrant. Apparently, a package was delivered to his address which allegedly contained a distribution amount of methamphetamine. It was estimated that a total of 8-ounces of meth was in the package. Detectives apparently knocked on his door and asked if his name was on the shipping label and he said it was. They then handed him the package and he had possession of it. They then served a search warrant at that location.

They later also served a warrant at his home, at the time being at 531 East B. They allegedly found packaging materials, a marijuana pipe as well and digital scales. The apartment on East Sherman is within a thousand feet of a school.

Charges include possession of methamphetamine with intent to sell within a thousand feet of a school, possession of drug paraphernalia with intent to package, no drug tax stamp, possession of marijuana, personal use drug paraphernalia and possession of Hydrocodone with intent to sell within a thousand feet of a school.

The case is pending a jury trial in District Court, but that may not happen now that the case is being referred to the feds.
