The case against 32-year-old Hutchinson man convicted of arson for going into a woman’s home and starting a fire goes before the Court of Appeals Tuesday.

Lee Vogt was convicted of going into the home at 1129 East C, where a woman lived with her small child.

Vogt is charged with starting the fire, then calling her to tell her prior to the fire being called in to the fire department.

Crews called to the scene around 1:30 a-m, on May 9, 2010 and when they arrived the back third of the house was engulfed in flames. Crews tried to enter the dwelling to do a search but were driven off after a portion of the home collapsed.

The two victims lived in the home which was owned by the woman’s father.
