The 21-year-old Hutchinson man who was granted 24-months community corrections with an underlying sentence of 66-months for his involvement with the break-in of vehicles of law enforcement, public officials and other citizens failed to show in court Friday morning, however he did show up Friday afternoon and the bench warrant issued earlier was recalled.

Victor Smith was arrested last week on a corrections violation, and the state is now seeking to have his corrections revoked. In a court filing dated December 17, the state argues that his corrections should be revoked because of consuming alcohol around December 12, something they say he admitted to, but not only did he consume alcohol, he was arrested for driving under the influence and obstruction in Sedgwick County. It’s also a violation to leave Reno County without permission of his corrections officer.

He was able to post a 25-thousand dollar bond and was scheduled for a hearing on the violations this morning in front of Judge Tim Chambers, but failed to show. So, Judge Chambers issued a bench warrant for 50-thousand dollars, but again, he showed up in court Friday afternoon and appeared in front of Judge Joe McCarville. He apparently thought that was where he was supposed to appear.

In the burglary case, Smith entered a plea to conspiracy to commit burglary and felony theft.

Smith also entered pleas in a drug case to possession of cocaine with intent to sell and possession of marijuana. He had earlier faced the additional charges of possession of drug paraphernalia with intent to use to package a controlled substance for sale, no drug tax stamp, and possession of personal use drug paraphernalia.

In the third case, he entered a plea to leaving the scene of an accident where great bodily harm occurred where he left a Hutchinson woman in the ditch after a motorcycle crash.

A hearing on the motion to revoke was set for January 11, and he was assigned an attorney through the Regional Public Defenders Office.
