A 20-year-old Hutchinson man facing charges of intentional second degree murder and criminal possession of a firearm waived his right to a preliminary hearing Monday afternoon meaning the case will move to arraignment next month, and a possible jury trial at a later time.

Isaac Devante Beltran appeared by video from the Reno County Jail while friends and family of both sides packed the small Position 1 courtroom with tight security inside and out.

Beltran rarely looked at the camera and only answered questions of Magistrate Judge Randy McEwen. In fact, most of the time, you couldn’t see his face. The hearing lasting about 5 minutes.

He was arrested as a result of the shooting death of 26-year-old Dustin Brooks in the alley behind the home where Beltran lived 203 North Cleveland Halloween night, this past year.

Brooks suffered a gunshot wound to the torso and died after emergency surgery failed at Hutchinson Regional Medical Center.

Once the hearing was over Monday afternoon, law enforcement were also present outside the courthouse to make sure there was no trouble between the two sides as result of the killing. They had the victims family and friends leave first, but then hung outside the courtroom. So they allowed Beltran’s family and friends to leave the courtroom normally reserved for the judge and law enforcement. They then left using the law enforcement door, while Brooks family and friends left through the main courthouse doors. The two sides still met up because of being parked in the same general area. Law Enforcement from both the Sheriff’s Office and Hutchinson Police were on hand to keep order.

Beltran has been on community corrections for a drug conviction which goes back to December of 2010 and the motion to revoke his corrections is expected to be heard by District Judge Tim Chambers at some point at a date yet to be determined.

Arraignment in the case will be on February 4, in front of Judge Tim Chambers. Beltran remains jailed with a bond of 150-thousand dollars.
