Hutch Man Charged With Aggravated Indecent Liberties Enters “No Contest” Plea

A 22-year-old Hutchinson man charge of aggravated indecent liberties with a child entered a “no contest” plea in the case this afternoon.

Zachary Brawner is alleged to have had sexual relations with a 15-year-old teen with the initials B.L.S. It’s a violation of state law for sex with an underage teen even if its consensual. The alleged crime occurring back on September 10, 2011.

Apparently, he met the girl on Facebook and also talked with her on the phone. She indicated that she would be at her grandmothers home and he apparently came and picked her up and they went to the fair. They then returned to the grandmothers home where the sexual encounter occurred.

He apparently felt guilty and turned himself in. According to statements made in court, he told the officer who took the initial report that he knew she didn’t want sex, saying he could see it in her eyes, plus he told the officer that he knew she had a boyfriend. He alleged that he raped the 15-year-old, but the state charged him with the indecent liberties count.

The charge carries a sentencing range of 55 to 247-months in prison, depending on the defendants prior criminal history. The sentencing by Magistrate Judge Randy McEwen was set for March 8, at 10:30 a-m.
