A 25-year-old man arrested back on July 29, of last year was back in court Monday on two counts of aggravated assault with a deadly weapon, possession of marijuana with intent to sell, possession of drug paraphernalia with intent to distribute, two counts of criminal threat, and personal use drug paraphernalia.

Korey Byard of 216 North Park Drive was bound over for trial as charged resulting from an incident where he allegedly pulled a gun after his glasses somehow got broken at a large party at a home in the 4000 Block of East G.

Sheriff officials say they were dispatched to that location on the report of someone threatening people with a 9 mm handgun. Deputies were able to stop the vehicle that Byard was in and he was placed under arrest. He allegedly admitted having a handgun in the vehicle, but claims he pointed at the two men in self defense, and that it wasn’t loaded.

But, Brandon Thompson who was a guest at the party was there and told the court that Byard was waiving the gun around and told those present that someone needed to be shot for breaking his 400-dollar glasses.

He had earlier been asked to leave when he was caught trying to steal some alcohol at the party which was being held inside the shed.

After he was stopped in his brothers vehicle, sheriff deputies say they found a gray and orange backpack and inside was a jar containing a green leafy substance believed to be marijuana, in a distribution amount. They also allegedly found numerous Ziploc coin baggies, a digital scale, several pipes typically used for smoking pot, a grinder and papers used for personal use of pot.

Deputy District Attorney Tom Stanton says he will add an additional charge of “attempted theft” prior to Byard being arraigned on April 1. That will be in front of Judge Trish Rose.
