A Hutchinson woman was bound over for arraignment and possible trial Tuesday morning on a more severe charge of aggravated battery.

Janey Pontius had been charged with a level seven felony, but the state requested that Judge Joe McCarville allow them to increase it to a level four which carries a more severe penalty. That came over the objection of Defense Attorney Charlie O’Hara who says he doesn’t believe the crime includes disfigurement of the victim. Judge McCarville decided to let a jury decide.

Pontius is charged in the case for allegedly striking the victim with a beer bottle three or four times during what the victim claims was an unprovoked attack.

The victim testified that she knew that Pontius didn’t like her and tried to stay clear of her at Vic’s Bar back on January 6, of this year. She had just gotten a drink at the bar and then says she walked five feet to talk with friends when the attack occurred.

She says she received three big knots to the head and a cut on her forehead which she says was gushing blood. She had to be taken to the hospital to be treated and received stitches as a result. That also left a permanent scar.

With Pontius being bound over, she’ll be arraigned on October 7, in front of Judge Trish Rose.

She also has another case still pending for a charge of aggravated interference with parental custody. In this case, she’s alleged to have tried to detain or conceal a child from its parent and taking the child out of state without the consent of the person having custody or the courts.

She will be back in court on that charge on October 17, for a preliminary hearing.
