They almost got a preliminary hearing started Thursday afternoon for two men arrested back on May 5 on drug distribution charges.

But at the last minute, Deputy District Attorney Tom Stanton announced in court that they didn’t have the lab reports from the KBI. He was willing to proceed with the hearing against 24-year-old Rayland Brown of Hutchinson and 21-year-old Dwayne Lewis of Wichita, but Lewis told his attorney he didn’t want to proceed without the report. Brown’s attorney was willing to proceed, but knew the state wouldn’t want to proceed and have to call witnesses twice.

Judge Joe McCarville agreed to the continuance and set the hearing again for November 14.

The two men are charged with possession of crack cocaine and marijuana, both with intent to to distribute and possession of drug paraphernalia with intent to package. Lewis was also arrested for driving while suspended, allegedly an habitual violator.

A Hutchinson Police Officer made a traffic stop in the 500 block of East 1st. That allegedly led to the discovery of crack cocaine and marijuana, both allegedly in a distribution amount.

Brown has another case pending where he’s charged with the sale of cocaine going back to February 27. Stanton told the judge he didn’t have a lab report in that case either, so it will also be heard on November 14.

Both men are under supervision here in Reno County for previous drug cases and both were denied bond reductions Thursday because of the other crimes as well as the pending charges. Brown had just finished serving 60-days as a sanction for violating his corrections.

He has convictions for sale of drugs, being in possession of a precursor for the manufacture of meth, possession of opiates and no drug tax stamp.

Lewis has previous convictions for the sale of drugs, possession of drug paraphernalia and no tax stamp. He faces a hearing on a corrections violation for those convictions.
