A 30-year-old Hutchinson man arrested after he allegedly sold a half pound of marijuana to an undercover drug detective waived his right too a preliminary hearing Wednesday and entered guilty pleas as charged.

Kenneth Boyer entered pleas for the sale of marijuana, possession of marijuana with intent to sell, and two counts of no tax stamp. The state agreed to not file an additional case of the sale of marijuana.

The case centers on Boyer meeting with an undercover detective in the parking lot of Family Video at 30th & Severance. This in the late evening of August 19. He sold the detective a half pound of marijuana for 500-dollars. He was then arrested and allegedly told detectives that he had more pot at his home and took the officers there where allegedly another 392-grams of marijuana was found in four different baggies.

There was some concern that the deal might be in trouble because Boyer was apparently arrested Tuesday for possession of marijuana, possession of drug paraphernalia and disorderly conduct. But, Deputy District Attorney Tom Stanton says he was unaware of the new arrest, but didn’t believe it would effect the agreement.

Allegedly Boyer had two pipes on him at the time of his arrest.

Although the plea was made in front of Magistrate Judge Randy McEwen, sentencing will be on January 3, in front of Judge Tim Chambers.
