A 35-year-old Hutchinson man was bound over for trial Wednesday after a preliminary hearing in two cases, while a third is already pending trial.

District Judge Joe McCarville found there was probable cause to send a case against Levar Simon to trial on a charge of sale of cocaine, no tax stamp and use of an electronic device to arrange a drug transaction. This case goes back to March 13, and involved a undercover informant allegedly making a buy of at least 3.5 grams of cocaine from the defendant.

The second case goes back to March 28, when he’s accused of the sale of cocaine within a thousand feet of a school. This sale, allegedly less then 3.5 grams of cocaine. The state was also allowed to add the charge of use of an electronic device to arrange the sale. This case also involved a controlled buy with a confidential informant.

Simon was already facing trial on charges of possession of cocaine with intent to sell within a thousand feet of a school, no tax stamp and possession of synthetic marijuana. This case coming from a drug unit search of his home on March 30.

Simon is no stranger to the law and has served time in prison for voluntary manslaughter, drugs and three counts of criminal possession of a firearm.

He’ll be arraigned on the two cases on January 6, and remains jailed on a 40-thousand dollar bond.
