Civil action is being taken against the owners of the Hutchinson Mall. In a order filed December 27th in Reno County District Court, the US Bank National Association and GS Mortgage Securities Corporation entered into an agreement with Rubloff Properties to take possession of the mall. The court has been advised that the defendant in the case has agreed to the order filed. McKinley Realty LLC has been appointed to act as the receiver with respect tot he property and the court further orders that all financial information be turned over and that steps are taken to prevent waste and safeguard the property.

It also calls for McKinley to manage the property until upon further court order and with the consent of the plaintiff, sell the mall. The suit brings the mall closer to a possible sale and what many hope will be a new owner that will take more stock in its assets. The mall has been in steep decline over the past two years loosing Dillard’s, Radio Shack, the Armed Forces Recruiting Station, Hallmark and Christoper and Banks.
