HUTCHINSON, Kan. — A Reno County jury reached a verdict Wednesday afternoon in the case against 27-year-old Michael Sherman and found him “guilty” attempted first degree murder for allegedly attacking Reno County District Attorney Keith Schroeder.

The jury got the case against Sherman around 9:30 a.m., Wednesday morning and reached a verdict around 4:15 p.m.

Sherman is now guilty of attacking Schroeder after retired Judge William “Buck” Lyle upheld his sentence in the child sex case involving aggravated criminal sodomy. He jumped on Schroeder who was sitting at the prosecution table a few feet away. This allegedly occurring back on July 10, of last year.

The state contended that the attack was premeditated because Sherman was upset that Schroeder didn’t back a lesser sentence then life in the aggravated sodomy charge he was convicted of. The state contended all along that the defendant planned what he was going to do the night before. The defense doesn’t deny that the attack occurred, but says Sherman never intended to kill Schroeder saying there was no premeditation.

The jury did ask if there was any lesser charge they could consider. The complaint at one time included an alternate count of aggravated battery, but that was dropped by the state.

Again, he was found guilty of attempted first degree murder and Judge Trish Rose set sentencing in the case for July 28.

You may recall that Sherman had been sentenced to life in prison with no chance of parole for 25-years for a conviction in the sodomy case involving his own 4-month-old child. But, Judge Rose last month departed from Jessica’s law making the crime of aggravated criminal sodomy a level one person felony and sentenced him to 13 years, 9 months in prison. Any sentence handed down in this latest case will run consecutive meaning time will be added to the nearly 14-years, he’s already serving.
