After the Kansas Court of Appeals last April ruled against a former Sterling College Football player, sentenced to seven years in prison for a fatal car crash that killed two people south of South Hutchinson. The only question remaining in the case is possible restitution to the two surviving victims, and the family of the two killed.

Robert Silhan of Valley Center had been ordered to serve the rest of his sentence after loosing his appeal. He was convicted of two counts of involuntary manslaughter and two counts of aggravated battery.

The case centers on the April 14, 2006, car crash that killed Adrian Crosby and Dominique Green, of Wichita. It also injured the two young men’s girlfriends.

The crash occurred just south of South Hutchinson where Silhan was apparently legally intoxicated with a blood alcohol level of .17. He was driving north in the southbound lanes of K-96 and he struck the vehicle with Crosby and Green killing both of them, and injuring their girlfriends.

He had been released from prison in 2007 on a $10,000 appeal bond while waiting a decision on his appeal. Once his appeal was denied, he was ordered to prison to serve the rest of his sentence.

He then filed a motion to withdraw his plea, claiming he had an impaired ability to understand the judicial process and ineffective council. That was denied.

His case came back to District Court Friday over a single issue, restitution. No exact number has been named, but according to Judge Trish Rose, it could be as high as 23-thousand dollars.

Silhan didn’t appear in court on the matter, only attorney’s and it was decided that they would have a hearing on December 6, to determine the exact amount.
