Judge Trish Rose as expected did issue a written opinion on a couple of issues in the cases against 41-year-old Bradley Verstraete.

As we told you earlier, he had been found not guilty of a number of aggravated assault charges against law enforcement because the jury believed he suffered mental illness. He reportedly threatened law enforcement officers with a machete when they responded to concern for welfare case back in 2008. Judge Rose took under advisement earlier this week on whether to send him to Larned in that case, and ruled Thursday that he should. That means he could be there for indefinite amount of time.

On Wednesday Judge Rose sentenced Verstraete 21-months for felony battery of a law enforcement officer involving the same incident, but also ordered time served because he has been in custody in the case since February of 2009. The question here was how much post-release supervision should he have for the conviction. According to the written order she issued Thursday, that would be 12-months. Of course at this point, it may be moot, since he’s going to Larned.

The incident involving two trials occurred back on February 22, 2008 when police were called to a home at 726 East 1st, on the report of residents having trouble with Verstraete, but also concern for his and others welfare. Verstraete had reportedly threatened four officers with the machete when the arrived at that home.
