A 28-year-old Wichita man who was convicted of four counts of aggravated assault with a deadly weapon and criminal possession of a weapon was ordered to prison after he was found to have violated his community corrections for aggravated assault charges in Sedgwick County.

Dwain Smith had been sentenced to 24-months community corrections on a 62-month sentence by Judge Joe McCarville for pointing a handgun at four people back on March 13, 2009. He was in violation for even having a gun because of a previous case where he was convicted of domestic battery for a case in Crawford County.

The state and the defense had agreed to recommend the community corrections which was granted by the judge, but then came word of cases in Sedgwick County where he was being supervised that he had assaulted his girlfriend Natalie Switzer Haule on a number of occasions. One she was choked so bad that she lost consciousness, and another time was taken to a Wichita hospital after she had been beaten where she suffered head injuries and her lip.

Judge McCarville agreeing with the state that Smith has proven that he was a danger to society and ordered the 62-month sentenced be served.
