An Arlington couple charged with abuse of child for using a stun gun against their son and later charged with intimidating there son over his testimony and another witness who actually filmed one of the tasing incidents were each bound over by Magistrate Judge Randy McEwen Thursday.

Leigh Foster was also bound over for a second count of aggravated intimidation of a witness for reportedly sending a letter to one of the victims who apparently owed the couple money. The Fosters reportedly filed a civil suit against that victim over the money issue. But, Magistrate Judge Randy McEwen found there was not probable cause that Jerome Foster was involved with that.

Their adopted son says he was told that if he came back home and admitted to officials that he made up the allegation of child abuse, he wouldn’t have to do any chores.

The state contends they tried to dissuade the victims from attending or giving testimony in the case and say in the complaint it was done in furtherance of a conspiracy.

The two intimidation incidents, allegedly occurring on April 22nd, and May 18th.

The original charges were brought because the couple allegedly abused their son by tasing him at least twice, and in one case, he was struck on his hand with a baseball bat. The alleged crimes occurring between September 1st, and November 14th, of last year.

The case was investigated by the Reno County Sheriff’s Office after they were notified by SRS officials who apparently were notified by school officials. During the preliminary hearing, the state also showed a cell phone video which allegedly shows one of the tasing incidents.

The defense attorney’s indicated they would seek to have the two defendants arraigned a week from Friday on the latest charges, so when the original case goes to trial on December 20, they can also be tried on the intimidation charges as well.
