The preliminary hearing for three men arrested back in August by the Reno County Drug Unit for being in possession of a good amount of high grade marijuana was continued because the state wasn’t ready to proceed with a motion to suppress filed by one of the attorney’s.

Charged with possession of marijuana with intent to distribute and having no drug tax stamp are 27-year-old Travis Davis and 28-year-old Dustin Goff, both of Hutchinson, and 26-year-old Shane Hughes of South Hutchinson.

Senior Assistant District Attorney Steve Maxwell explained to Magistrate Judge Randy McEwen that these cases are not his and that the motion had just been filed on Tuesday. The motion is apparently over whether the drug unit had probable cause to make the traffic stop. Apparently, they have not been provided with the affidavit for the search of the vehicle the three were in. Maxwell explained that Deputy District Attorney Tom Stanton had not released that because it contained the name of the confidential informant. Judge McEwen then asked if the name could be redacted and Maxwell said he thought it could. So there may be another hearing scheduled later.

Drug Unit officials at the time of the arrest stated that they had been investigating the trio and then got a warrant to search the truck the three were in. They had a sheriff deputy make a traffic stop in the 6900 block of North K-61.

Allegedly, they found a suitcase in the back seat of the vehicle next to Davis that contained 2.5 pounds of the marijuana which according to the drug unit had an initial value of 10-thousand dollars. But, once sold would bring in considerably more in profit.

No new date was set for a new hearing.
