HUTCHINSON, Kan. — The preliminary hearing for a 32-year-old man charged with aggravated battery for allegedly stabbing a 30-year-old man after the two got into an argument resumed Thursday afternoon.

Judge Joe McCarville granted a recess in the case against Drew Sims because the victim was not present at the last hearing. This time Brandon Zeh did take the stand and admitted in court that Sims may have been trying to defend himself the morning he was stabbed. Zeh said Sims and Kim Goertzen drove him home from work in the early morning.

At that time Sims admitted to Zeh that he damaged his door earlier in the overnight hours. The pair left, but when they came back, Zeh testified that he ran downstairs and opened the door.

That’s when he was stabbed. Zeh testified that he asked Sims if he just stabbed him, Sims said “yes.” Zeh asked why and testified that Sims was almost panicked when he answered, “I don’t know.” Despite almost defending his attacker, Judge McCarville bound Sims over for trial.

Arraignment is set for June 1 with probation violation hearings on two other cases set for May 29.
