It’s no real surprise that a hearing for one of two men arrested back on October 23 on marijuana distribution charges was continued. That’s not unusual considering that Kiel Bale could be looking at prison time if they decide to revoke his probation in a previous case and most because attorney’s don’t want to see their clients go to jail during the holidays.

Bale along with Rusty Shawn Decker are both charged with possession of marijuana with intent to sell, possession of drug paraphernalia with intent to distribute and no drug tax stamp.

The case starts with Hutchinson Police Officer David Post spotting a black Ford Expedition driving north on Plum from 17th. The vehicle then turned east on 30th, then turned south on Acres Rd. The vehicle then stopped in the 2800 block of Acres, where the officer then made contact with the two men inside.

They discovered Decker had some warrants and he was placed under arrest, and then the officer says he smelled marijuana. They discovered a small black container with suspected marijuana, then inside a speaker box, they found more suspected pot which weighed about 30-grams. Also found was some coin baggies, and a silver scale.

Neither would accept responsibility for the pot and both were arrested.

Decker was also jailed for other charges of criminal damage to property, and battery, intentional reckless bodily harm.

Bale was scheduled to be in court for a preliminary hearing Tuesday, as well as the probation violation from a previous case, but are now continued until until January 23. The state is seeking to have his probation revoked in light of his latest arrest.
