The trial for a Hutchinson woman charged with 2nd degree murder will go as scheduled on January 10. That was the ruling this morning by District Judge Trish Rose. The defense for Brigit Hippen had requested the continuance for the second trial, but that was denied.

Hippen faces the second trial for 2nd degree murder in association with the death of her 2-month old child. The state argues that she was reckless when she placed a blow dryer on a counter near the crib her child was sleeping in, this in the bathroom of the apartment she shared with Oscar Perez. She said she placed it there because of concern for the child being to cold. The child died from hyperthermia as a result of that. It was back on February 23 of 2010 that Hippen and Perez took the child to Promise Regional Medical Center where the child was pronounced dead shortly after. The state alleges Hippen was reckless with her acts, and showed extreme indifference to the value of human life.

Meanwhile, Judge Joe McCarville found there was insufficient evidence to support a charge of aggravated battery against Hippen in a seperate case, but did find there could be an argument for misdemeanor battery for an incident which occurred back on May 29. She was also bound over for trial for felony criminal damage to property.

Hippen allegedly punched another woman in the face for dancing with Perez. The victim in the case, Desire Jenson had a retainer in her mouth and the evidence showed that the broken teeth were actually attached to the retainer. However, there was some bleeding in her mouth leading to the judge finding probable cause for the misdemeanor battery.

Hippen also allegedly caused damage to the victims vehicle, including damage to her windshield, and the hood as well as other parts of the vehicle. Damage estimates were set at 3-thousand, 250-dollars according to Roy McQueen with McKenzie’s Paint and Body who also testified at the Wednesday hearing.

Arraignment for the battery and criminal damage case will be on January 3rd.
