OLATHE, Kan. (AP) — A third man has been convicted in the killing of a suburban Kansas City gun shop owner during an attempted robbery.

The trial for 22 -year-old Nicquan Midgyett, of Kansas City, Missouri, was underway when he pleaded guilty Wednesday to first-degree murder, attempted aggravated robbery, and conspiracy to commit aggravated robbery. He previously pleaded guilty to aggravated battery. Sentencing is set for March 8.

Gunfire erupted during the January 2015 attempt to rob a Shawnee, Kansas, gun store called She’s a Pistol, which catered to women. Forty-four-year-old Jon Bieker was killed and three would-be robbers, including Midgyett, were wounded.

Two other defendants, Hakeem Malik and Londro Emanuel Patterson, have been sentenced to life in prison. A mistrial was declared last month in the case of the fourth defendant, De’Anthony Wiley.

LAWRENCE, Kan. (AP) — A Lawrence teenager who pleaded guilty to killing his grandmother wants to withdraw that plea.

Eighteen-year-old Jaered Long was scheduled to be sentenced Tuesday for second-degree murder in the December 2015 death of 67-year-old Deborah Bretthauer.

Instead, Long’s attorney, Forrest Lowry, told the Douglas County court that his client wanted to withdraw his plea.

The Lawrence Journal-World reports a hearing was scheduled for Feb. 20 to consider the request, or to sentence Long if the request is denied.

Authorities said Bretthauer was stabbed dozens of times with a knife while she was in bed in her Lawrence apartment.

One of Long’s therapists previously testified that she asked Bretthauer to consider residential treatment for her grandson’s worsening abusive and threatening behavior but Bretthauer didn’t agree to the plan.

WICHITA, Kan. (AP) — A suburban Kansas City couple whose home was raided by police in a fruitless search for marijuana has lost their lawsuit against Johnson County.

A federal court ruled Tuesday that Adlynn and Robert Harte of Leawood should not receive any monetary damages for the 2012 SWAT-style raid by deputies looking for a marijuana growing operation.

The Hartes contended that deputies lied to get a warrant to search their home.

Law enforcement targeted the home after Robert Harte and his children went to a hydroponics gardening store. Deputies then took loose tea leaves from their garbage. Deputies said the leaves registered positive for marijuana but they were never submitted to a lab for more definitive tests.

Attorneys for the Hartes say they will appeal.

Just after 7:30 a.m. Tuesday, officers responded after a 28year-old man reported his 2006 Silver Honda Ridgeline being stolen from the 700 block of east Osie in Wichita, according to officer Charley Davidson.

The vehicle had graphics on the side of the vehicle for Wichita Brewing Company.

On Wednesday an alert citizen saw the stolen vehicle at the Valero in the 2000 block of east 21st Street north and alerted police.

Officers located the vehicle nearby and a chase ensued. The vehicle was then located unoccupied in the 2500 block of east 8th Street.

Officers located 4 individuals in the area ranging from 16 to 27 years of age with the help of neighbors in the area. One 23-year-old man was arrested and booked into jail for auto theft and felony evade and elude. A 21-year-old male was also arrested and booked into jail for unrelated warrants, according to Davidson.

FINNEY COUNTY — Law enforcement authorities are investigating a suspect for alleged rape, aggravated kidnapping and asking the public to help locate her.

Police say 29-year-old Ashley Nicole Perez is 5-foot-6, has black hair and weighs approximately 145 pounds. She has prominent tattoos. “Lips Melinda” on her neck. “Smile now or cry later” on her right forearm and “Garden City’ on her left hand.  She was driving a red, 200 Chevy Cavalier.

LENEXA, Kan. (AP) — The Johnson County District Attorney says an off-duty police officer who shot and killed an armed man who was threatening customers at the Costco in Lenexa will not face any charges.

District Attorney Steve Howe said Wednesday that Kansas City, Kansas, police Capt. Michael Howell saved innocent lives during the confrontation on Nov. 26.

Ronald Hunt entered the store with a gun and was threatening to shoot customers. While store employees and customers were being evacuated, Howell identified himself as a police officer and told Hunt to drop the weapon.

Investigators say Hunt ignored the commands and threatened Howell, who shot him.

No one else in the store was injured.

Howe said Howell acted in self-defense and in defense of others, which is allowed by Kansas law.

SEDGWICK COUNTY— Law enforcement authorities are investigating an injury accident involving a wrong-way driver that injured three people

Just after 1a.m. Wednesday, officers responded to report of a wrong-way driver at Kellogg and Zelta in Wichita, according to officer Charley Davidson.

First responded found a 2012 Ford F150 traveling westbound in the eastbound lanes in the 300 Block of East Kellogg.

Officers successfully deployed a tire deflation device to stop the pickup in the 9000 Block of West Kellogg and made contact with the 48-year-old driver.

While the pickup was traveling the wrong direction, a driver of an Acura made an evasive maneuver and collided with a Kia SUV.

Three occupants of the Acura and the driver of the Kia received non-life threatening injuries, according to Davidson. Police did not report an arrest but Davidson did indicate alcohol could have been a factor in the crash.

DICKINSON COUNTY – Law enforcement authorities and others in Dickinson County have been investigating a burglary  since November of last year and have good news.

The Russell Stover Candies bear taken during the overnight hours of November 4th, 2016  from in front of their factory in Abilene is back.

Police reported on social media Wednesday morning they recovered the bear. They did not released additional details.

During the overnight hours of November 4th, unknown suspects stole the beloved Russell Stover Candies bear from in front of their factory in Abilene, according to Abilene police.

SHAWNEE COUNTY —Law enforcement authorities are asking for help to locate a missing Kansas felon.

On Wednesday, the Shawnee County Sheriff’s office issued the alert for 23-year-old Keegian R. W. Hamilton on the charge of Criminal Possession of a Weapon by a Felon; convicted within 5 years.

Hamilton has two previous drug convictions in Geary County, according to the Kansas Department of Corrections.

KANSAS CITY(AP) – Authorities say a FedEx driver has been killed in a fiery, multi-vehicle wreck in Kansas City.

Police Capt. Joe Crayon says the crash happened Tuesday on Interstate 435 when the FedEx driver rear-ended a pickup truck that was stopped in traffic. The FedEx truck then crashed into a guardrail.

The Kansas City Star reports that several people tried to help the driver but were unable to reach him. Four vehicles were involved, and the crash stopped traffic for several hours while police gathered evidence. There were no other serious injuries.

The driver’s name has not been released, pending notification of relatives.

FedEx offered condolences to the family and friends of those involved in a statement. The statement also said that the company is cooperating fully with authorities.
