HUTCHINSON, Kan. — All four young men waived their rights to a preliminary hearing and then entered pleas involving the robbery of a local Kwik Shop and the burglary of a smoke shop.

The court proceeding started with Kurt Koenig, who is free on bond, waiving his right to a preliminary hearing. Then after the other three waived their hearings and entered pleas, Koenig then agreed to enter a plea as well. He entered a plea to conspiracy to commit aggravated robbery with all the other charges dropped.

Nineteen-year-olds Karl Koenig and Drake Lindsay entered pleas to aggravated robbery and conspiracy to commit burglary with all the other charges dropped.

Eighteen-year-old Dakota Ney, who was prepared to testify against the other three, entered a plea to aggravated robbery with all the other charges dropped.

The four were involved in the robbery of the Kwik Shop at 43rd & Plum back on Jan. 27. Kurt Koenig drove the other three to the store with a mask, gloves a toy gun that looked like a real one, a machete and a taser device.

It was Ney that forced the clerk to open the drawer and give money while the other two stole cigarettes and other items. He is also the one who knocked the victim to the floor, using the taser device on her and kicking her. She still suffers from those injuries today and appeared in court with a walker.

Hutchinson Police Detectives executed two search warrants where they found a large amount of the stolen property from the Kwik Shop robbery and items from the burglary of the smoke shop, which occurred a few days after the robbery on Feb. 1.

Sentencing for all four will be on August 5. Karl Koenig will be sentenced by Judge Trish Rose while the other three will be sentenced by Judge Tim Chambers.

None of the defendants can ask for any departure or a non-prison sanction. They will be sentenced based on any criminal history with the sentencing grid box they fall under.
