The 37-year-old Buhler man involved in a two vehicle fatality accident and arrested on suspicion of aggravated battery with a deadly weapon, vehicular homicide or involuntary manslaughter while under the influence of alcohol as well as DUI is expected in court Friday for arraignment in the case.

Matthew Yoder was bound over for trial back on December 4, but with an additional count of aggravated battery added by the state. 23-year-old Kyle Ridgeway of Hutchinson testified that he suffered a dislocated shoulder from the accident.

It was July 26, 2011 when Yoder was going north on Elm just after 2:30 a-m, when he ran a stop sign at the intersection with east 11th, was hit broadside by the west bound car driven by Ridgeway. His car continued to the northwest part of the intersection where it hit a utility pole.

A Passenger in Yoder’s vehicle, 29-year-old John Senabulya of Hutchinson was killed in the collision. Yoder was taken by Lifeteam Helicopter to Via Cristi, St. Francis Regional Medical Center with head injuries, but has since recovered. A third person in the car was taken to Hutchinson Regional Medical Center. Ridgeway was also taken to Hutchinson Regional for observation, but apparently did suffer some injuries.

Yoder allegedly had a blood alcohol level of .11. He had told officers that he had five rum and Cokes while at a local nightclub.

The arraignment will be in front of District Judge Trish Rose.
