The case against one of three men convicted in the killing of a Hutchinson man in 2008 is went before the Kansas Court of Appeals Tuesday which met in Hutchinson.

32-year-old Felton Williams Jr., convicted of killing of 21-year-old Kenneth White back on September 1st, 2008 argued a number of issues.

The first being the search of his vehicle by Oklahoma State Troopers. They apparently asked to search his vehicle, and understood him to say, ya, go ahead. But, he claims that he told them “no.” District Attorney Keith argued they had probable cause anyway, because he has the smell of alcohol on him, and admitted he had been drinking.

The defense also argued that the court erred when they allowed prior crimes evidence to be presented at trial, such as drug dealing and other narcotics charges.

Then there was some question over his criminal history score at sentencing,

The case center on the shooting of White in his west side cottage. He had been shot twice, once in the leg, and then the fatal shot to the back of his head at his west side Hutchinson home. He along with Aubrey Oliver, Ronald Beard were caught later that day after being stopped by the Oklahoma Highway Patrol.

Williams was convicted of murder in the 2nd degree and sentenced to just over 20-years in prison. He was thought to be the actual shooter of White.

Oliver entered a plea in the case to a reduced charge of conspiracy to commit murder and was sentenced to nearly 11-years in prison for his part in the murder. He also agreed to testify against the other two, but recanted most of what he said. Beard was found not guilty for any involvement in the case.

Of course these were only arguments before the court, and it may some time down the road before a ruling is issued.
