Trial date set for Hutch man facing charges associated with injury accident

HUTCHINSON, Kan. — Judge Trish Rose Monday set a trial date for a man charged in a case involving a chase through the city which resulted in a two vehicle accident.

56-year-old Curtis Cleveland faces trial of two counts of aggravated battery, with DUI added into the complaint, failure to stop at an accident, felony flee and elude and interference with law enforcement.

Cleveland was allegedly fleeing from a sheriffs deputy back on June 24, 2014, when he hit a small pick up driven by 26-year-old John Trussell of Hutchinson, at the intersection of G and Plum. Cleveland’s vehicle continued to Campbell Street before coming to rest in the yard of a residence there. He then allegedly tried to flee on foot but was quickly apprehended

Trussell and his passenger, a 10-year-old boy were both taken to Hutchinson Regional Medical Center for treatment. A passenger in Cleveland’s vehicle, 37-year-old Nichole Hansen of Wichita, was treated at the scene and released.

He entered a “not guilty” plea Monday during arraignment and Judge Rose set a tentative trial date in the case for June 9.

Suspect in marijuana cultivation case enters ‘Not Guilty’ plea

HUTCHINSON, Kan. — A 51-year-old man charged with his son in a marijuana cultivation case who waived his right to a preliminary hearing was arraigned Monday where he entered a “not guilty” plea.

Johnny Payne is charged with cultivation of marijuana, conspiracy to cultivate marijuana, possession of drug paraphernalia with the intent to cultivate marijuana and personal use drug paraphernalia. He was arrested along with Jonathan Payne back on November 23 on theses charges.

Drug Unit Detectives are alleged to have found 12 marijuana plants at the home in the 1500 block of North Monroe.

His trial expected to come sometime this summer.

Second arrest made for mushroom growing operation

HUTCHINSON, Kan. — A second person has been arrested for a mushroom growing operation inside a north side business.

Jason Wineinger was arrested for suspicion of cultivation of mushrooms, distribution of mushrooms and cruelty to animals.

He faces charges along with 19-year-old Carlyeon Moore who faces charges of growing the mushrooms, possession of drug paraphernalia with intent to cultivate drugs, no tax stamp and cruelty to animals.

It was back on March 18, when Hutchinson police served a search warrant at the business at 2534 North Main. They found the mushroom growing operation. They also found a dog locked in a bathroom with no food and water and living in its own waste. Animal Control was called in and removed the animal.

Apparently they couldn’t find Wineinger when they did the initial search warrant, so they issued a warrant for his arrest and he was picked by police on Sunday. He was able to post bond meaning he probably won’t make an initial court appearance till Friday.
