Final suspect in Kwik Shop robbery sentenced to nearly 7-years in prison

HUTCHINSON, Kan. — The final of four young men convicted for being involved in the robbery of a local Kwik Shop was sentenced Friday afternoon to nearly seven-years in prison.

The attorney for 19-year-old Dakota Ney asked for a dispositional departure to community corrections for the conviction of aggravated robbery. But, District Judge Tim Chambers would have no part of that because of the violence involved by this defendant.

It was Ney who forced the clerk to open the drawer and give money while the other two stole cigarettes and other items. He’s also the one who knocked the victim to the floor, using the taser device on her and kicking and beating her. She still suffers from those injuries today and appeared in court with a walker. She was allowed to speak and told the judge that she can’t forgive him and doesn’t believe she should be allowed to walk the street. She told the judge, “I couldn’t live with that.”

The state was willing to knock nine months of the sentence over his cooperation with police which led to the arrest of the other three. But, Judge Chambers couldn’t agree to that considering the mental physical abuse the victim suffered.

Two other suspects, Nineteen-year-old’s Karl Koenig and Drake Lindsay entered pleas involving the Kwik Shop robbery as well as the burglary of a smoke shop. Judge Trish Rose sentenced Lindsay to five years and six months in prison while Koenig received a more harsher sentence of six years and seven months because of past criminal convictions for burglary and criminal damage.

Kurt Koenig was sentenced nearly two weeks ago by Judge Tim Chambers and was given two years, ten-months in prison after he entered a plea to conspiracy to commit aggravated robbery. He was the one who drove the vehicle for the other three and never actually entered the store.

The robbery of the Kwik Shop at 43rd & Plum occurred back on Jan. 27.
