A 29-year-old Hutchinson man arrested for an incident on August 14, was in court for a preliminary hearing Tuesday in front of Judge Joe McCarville where he was bound over for trial.
Jason Peterson is facing trial on charges of aggravated assault with a deadly weapon, in this case, his vehicle. Other charges included possession of marijuana, possession of drug paraphernalia, “a pipe” and criminal damage to property.
It was around 9:15 a-m, on August 14, when 35-year-old Michael A. Brisco reported that Peterson attempted to strike him with his vehicle. This occurring in the parking lot of an abandoned furniture store at 8th & Plum.
You might recognize the name Brisco as the person charged with first degree murder for the shooting of 26-year-old Sem Adrien, back on September 9.
Brisco took the stand and told of his vehicle being struck after the driver of the SUV seem to accelerate towards his vehicle. He says he jumped out of the way as a natural reaction over fears of being hit. He at the time believed the driver to be Peterson, in fact allegedly told Hutchinson Police Detective Tyson Myers that it was him, but in court seemed to back away from that saying he couldn’t be positive. He told the court that he had no problem with Peterson, but says his girlfriend did.
He also stated that his vehicle had already been totaled from the hail storm that struck the city and had been valued at 15-thousand, 500-dollars.
Later, Peterson was spotted by two Hutchinson Police Officers showing up for a municipal court case. They attempted to detain him over a warrant and he at first refused to take his hands out his pockets. When he did, a pipe fell to the ground. The pipe allegedly had marijuana residue inside.
This all happened prior to the shooting of Adrien which led to arrest of Brisco.
Peterson is no stranger to law enforcement with numerous convictions for burglary, theft, criminal damage, battery against a law enforcement officer, aggravated battery, drugs, criminal possession of a firearm and flee and elude.
Judge Joe McCarville found there was probable cause for him to face trial on all four charges and arraignment will be next Monday in front of Judge Trish Rose.
