A 24-year-old Hutchinson man was bound over for trial Thursday afternoon on three counts of rape and three alternate counts of aggravated indecent liberties with a child.

Salvador Araujo-Gutierrez had been charged with three counts of aggravated criminal sodomy, and three alternate counts of aggravated indecent liberties with a child, but District Attorney Keith Schroeder says based on the child’s testimony, the first three counts should be amended to rape, with the indecent liberties counts being the alternate counts to rape. Magistrate Judge Randy McEwen apparently agreed.

The alleged sexual abuse occurring over a period of time starting in 2006 and the last occurring back in 2011. The first incident involving the girl who was 7-years-old at the time and is alleged to have occurred during a period from July 1, 2006 and June of 2007. The second occurrence involving the same child when she was 10-or-11 years old occurring in June of 2010. The last one occurring between January 2nd, and 9th of 2011, when the child was 11-years-old.

The girl told the court that one of the encounters occurred while on the carpet in the basement of a home, and police were apparently able to pinpoint that portion of the carpet and test it. The report allegedly indicates that he had some type of sexual encounter on that carpet. His DNA was also present.

All of the charges are Jessica’s Law charges meaning that Araujo-Gutierrez could be looking three consecutive life sentences.

With his bound over for trial, he’ll be arraigned on the charges early next month.
