Hutch man enters a plea in burglary and battery case

A 39-year-old man accused of breaking into a Hutchinson home back in June, and also striking a Hutchinson man with a hammer entered pleas in court Tuesday to lesser charges.

John Harvey of 1004 North Obee Road had been charged with aggravated burglary and aggravated battery, but entered a plea to simple burglary and attempted aggravated battery.

He’s accused of entering a home 119 East 7th, and then battering one of the residents, 23-year-old Robert P. Fenton III. He also admits to stealing keys and titles belonging to Robert Fenton, Aimee Fenton, and Deven Monaghan. Police say he also damaged a television of his way out of the home. Harvey apparently didn’t know the alleged victims directly, but may have had mutual friends. This allegedly occurring back on June 17.

He remains free on a bond of 45-thousand, 250-dollars and is scheduled for sentencing on January 6, 2012
