HUTCHINSON, Kan. — A 34-year-old man who was sentenced to seven years and six months in prison for involuntary manslaughter has apparently filed a habeas corpus motion in Reno County District Court.

Kevin Wayne Ginn Jr. was convicted for the stabbing of 24-year-old Deshamus Diron Luckey during a large disturbance just after 2 a.m. New Year’s Day back in 2016. It happened in the area of 8th & Madison.

He was originally charged with voluntary manslaughter, but the state amended the complaint to murder in the second degree and added two other counts of voluntary manslaughter and aggravated battery.

Ginn entered a plea to one count of involuntary manslaughter with the other charges dropped as part of the agreement.

In addition to the sentence, he was also ordered to pay restitution of $3,865 to the family of the victim to cover some of the funeral costs.

A hearing in the civil case is scheduled for Friday in front of Judge Tim Chambers.

A habeas corpus motion is filed when a defendant has exhausted all appeals through the appellate courts.
