HUTCHINSON, Kan. — Last year, Cole Eugene McMann was charged in a domestic case. Wednesday, Magistrate Judge Cheryl Allen found McMann violated the terms of his court order by living with the victim. Records indicate he’s been staying with his wife since bonding out in 2017.

McMann was arrested May 15, 2017, in the 21000 block of West Parallel Road after he apparently got into an altercation with his father and another victim — his wife. He was charged with aggravated assault, criminal threat, battery and criminal damage to property.

He apparently arrived at the courthouse Wednesday with his wife for a court hearing. She didn’t come inside until 30 minutes after the hearing was scheduled to begin. The state believes it was a deliberate attempt to keep her from testifying. The defense denies that claim and disputes the charges, saying it was simply a family dispute; there was no gun, but maybe a pair of pliers.

McMann is accused of threatening the victim a gun. According to the state, McMann threatened to kill everyone. He’s also charged with striking the victim. Sheriff’s deputies indicated she had visible wounds. McMann has also been charged for causing damage to his father’s pickup.

Visibly angry with McMann, Judge Allen told him she believes he clearly showed disregard and contempt to the court order. Allen noted that Judge Joe McCarville told McMann to have no contact with the victim when the formal charges were read last year. The bond paperwork also indicated that McMann was to have no contact with the victim.

Allen ordered McMann be held with no bond until a preliminary hearing is held. Allen says she will ask Judge McCarville to schedule a hearing as soon as possible. The judge also told the victim she better show up for court or be held in contempt.

Judge Allen reiterated the no contact order between McMann and his wife, which includes phone calls and visits, while he’s in jail.
