While the other three defendants in a robbery and burglary case managed to get community corrections, the fourth didn’t fair so well.

19-year-old Derek Jaquez was sentenced to 42-months in prison for his part in the case where he and three others came to a home on south Reformatory, beat and robbed two individuals.

Jaquez had entered a plea with the state where they dropped the most serious charge of aggravated robbery, and the defense argued for community corrections. Jaquez apologized for the incident, and asked for the corrections saying he has a good job, is engaged and has a baby on the way. That didn’t impress Judge Tim Chambers who talked of how severely the two were attacked and says he cannot find any substantial or compelling reason to give a downward departure, and ordered the sentence served.

The two beaten were 22-year-old Corey Nemudrov and 21-year-old Nathan Carr. The crimes occurring back on July 23rd of last year. The beatings taking place in the front yard of the home at 212 S. Reformatory. One of the victims was transferred to a Wichita hospital due to the severity of his injuries and the other was hospitalized locally. Three of the four are then alleged to have gone into the home and stolen some electronic items.

Gregory Simmons entered the plea earlier this year to one count of aggravated battery and conspiracy to commit aggravated battery and was granted 36-months community corrections Friday on an underlying sentence of 63-months.

The other two defendants were 19-year-old Nathaniel Davis, and 19-year-old Schuyler Willis.

Davis was sentenced to a total of 82-months in prison, but then granted 36-months community corrections for his part in the robbery and beating. Willis is also on probation.
