The cases against a 23-year-old Hutchinson man scheduled to be held Friday in front of Judge Joe McCarville has again been continued at the request of the defense.

Leonardo J. Velázquez-Vieyra has been on community corrections for convictions of aggravated battery, theft, sale of marijuana, possession of drug paraphernalia for growing marijuana and no tax stamp and those corrections were revoked. However, he has not been ordered to prison thus far and repeated continuances have kept any decision on that from being made.

Velázquez-Vieyra was arrested in October on charges of aggravated kidnapping, aggravated battery, aggravated assault and felony theft. In court, he entered “guilty” pleas to aggravated battery, possession of drug paraphernalia and possession of marijuana from another case which was merged into the battery case. The state dropped all other charges against him.

The aggravated battery case apparently involves the mother of his child and started with a domestic dispute, where he allegedly held the victim against her will, caused injury with a vehicle, caused her to fear for her safety and allegedly take a vehicle without permission.

He also had four drug cases pending and they were dropped by the state.

Whenever the sentencing hearing is finally heard, they will decide whether he should be sent to prison for the violation of his community corrections. It’s now scheduled for May 10th, at 1:30 p-m.

One of those cases involves the shooting of Jordan Thomas. He and another man had shown up at an east-side Hutchinson apartment where Velázquez-Vieyra was staying, and Thomas was shot in the face with a shotgun. He lost his left eye as a result.
