HUTCHINSON, Kan. — A Hutchinson woman arrested for aggravated assault and being a felon in possession of a firearm, but failed to show in court for a preliminary hearing, was back before a judge Monday again seeking relief from her bond.

Thirty-two-year-old Kristen S. Ardolino is alleged to have pulled a large handgun and pointed it at her ex-boyfriend back on July 10, 2015.

She had earlier failed to appear in court for a preliminary hearing in the case leading to a warrant being issued. At an earlier court hearing, she admitted that she had absconded from her community corrections and failed to appear, worrying that she be found to be under the influence of cocaine.

The argument by the defense Monday was over getting a signature, also known as an OR bond, so she could get into intense out-patient treatment and, according to them, would be living at an Oxford House in Hutchinson. They argued that she has been clean for 60 days, isn’t a flight risk and argued that she went to get her belongings when the alleged confrontation with her ex-boyfriend occurred.

The state argued that it never received a written motion and was not aware of the defense argument until this hearing. The state argued against any bond reduction, but certainly not an OR bond because of the nature of the charges and the fact that she failed to appear for the preliminary hearing. The defense argued that she is under a lot of stress and that’s why she failed to appear.

Magistrate Judge Cheryl Allen told the defense that there would be no OR bond. “That flat isn’t going to happen,” Judge Allen said. However, she did agree to lower it from $50,000 to $30,000.

Ardolino has been on corrections for a drug case going back to 2014 and is listed by the Kansas Department of Corrections as an absconder.

The case is still pending a preliminary hearing.
