HUTCHINSON, Kan. — Should the case against a 26-year-old parolee bound over for trial for drug distribution be dismissed?

Judge Trish Rose heard arguments this week of the defense motion to dismiss, citing speedy trial issues.

DeCarlos Colbert is charged with possession of methamphetamine with intent to sell, possession of drug paraphernalia with intent to package, possession of marijuana, obstruction and no drug tax stamp.

Colbert was arrested after a search warrant was served on his apartment at 507 E. 3rd back on Oct. 22, 2014. Drug Unit Detectives allege that they found 12 individual bags, each containing a crystal substance, with a total weight of around 126 grams. Also located in a bedroom was an open box of sandwich bags and a digital scale with residue. In the living room, they allegedly found a grinder with green vegetation, which tested positive for marijuana.

While they were serving the search warrant, Colbert apparently drove up to the residence and, as they tried to make contact with him, allegedly ran into a field behind the home, but was quickly captured.

He’s currently free on bond and Judge Rose stated in court Friday morning that she would issue her opinion in the case by the end of the month.

Colbert has served prison time for the sale of drugs from a Sedgwick County case going back to 2008. He was paroled here in Hutchinson back in May of 2013.
