The jury trial for a 36-year-old Hutchinson man charged with aggravated battery of a law enforcement officer and drugs charges got underway Tuesday.

A number of officers testified in the case against Troy Harris who’s charged with aggravated battery of a law enforcement officer. possession of marijuana with a prior conviction, possession of methamphetamine and drug paraphernalia.

Harris was arrested after a traffic stop by police at 6th & Keast back on November 28, of last year and they discovered he had an outstanding warrant. As Hutchinson Police Detective Pat Voth attempted to take him into custody, the two struggled. He allegedly scratched and bit the officer. Voth also suffered a knee injury according to testimony Tuesday.

Physician Assistant Lynn Lavia testified that the officer was brought to emergency room and has suffered bite wounds on his left wrist, scratching marks on the left side of his neck, and also complained of pain with his knee. Although there were no fractures, Lavia testified that they can’t always see damage to the cartilage or muscle.

The defendant allegedly had drugs on him leading to the drug charges. Much of the testimony centered on a coat the defendant was allegedly wearing at one. It along with his shoes were allegedly found in a drainage ditch in that area where the altercation with the officer occurred.

The defense is arguing that the coat could have belonged to anyone and not necessarily the defendant. The coat not only allegedly contained the drugs and drug related items, but also a cell phone.

The case is expected to continue Wednesday in front of Judge Trish Rose.
