District Attorney Keith Schroeder is still contemplating what if anything he wants to do over a local defense attorney telling a victim that he was Deputy District Attorney Tom Stanton.

Allegedly, local attorney Sam Kepfield was asked Thursday whether he was Stanton, and he allegedly said “yes.” The woman then asked if she could leave to change the diaper on a child she had with her prior to taking the stand.

That woman was apparently a witness and victim in the Anthony McDaniels case, someone that District Attorney Keith Schroeder had been looking for. She was one of four witnesses the state had subpoenaed to testify in the case against McDaniels.

Schroeder says he’s more upset that Kepfield didn’t tell him that the woman was present. As we have been telling you, the state requested that the hearing be continued because of three of the four witnesses were not available. Turns out she was there, Schroeder just didn’t know it. Magistrate Judge Randy McEwen denied the states request for a continuance after Kepfield objected. Apparently McDaniels is still living in Michigan. Judge McEwen dismissed the case, but the state will appeal to a District Judge who can over-rule a magistrate. Schroeder telling us this was the first hearing into the manufacturing meth case since McDaniel came back to Kansas. He says, “we deserve at least one continuance.”

Schroeder says he has yet to decide what he might do about Kepfield claiming to be the deputy D-A. Schroeder says “I can understand why Mr. Kepfield would want to be Tom Stanton.”

Police did make a notation of what the state alleges happened with Kepfield, saying he was one of the prosecutors, but no charges or arrest have been made. When asked if this is an ethical violation on Kepfield’s part? Schroeder said he couldn’t comment on that.

You may recall that Kepfield made statewide news back in on November 23, 2009 when he was using a compulsion defense in a forgery case, placed the dud hand grenade on the bench in front of the jury and asked them if that intimidated them. When he didn’t get the response he wanted, he then allegedly pulled the pin and asked them again. He then slammed the grenade on the prosecution table. He nearly got arrested for the incident in court.
