A local attorney has been permanently disbarred by the states disciplinary board for misuse of funds in his care. David Holmes had appealed the disciplinary panels final decision before the Kansas Supreme Court asking he be suspended and given probation. That appeal was denied. The State Disciplinary Board found there was factual evidence of Holmes misusing a clients funds in two separate cases in Harvey and Reno Counties.

The panel ruled that Holmes engaged in intentional conduct which involves dishonesty, misrepresentation, fraud or deceit and denied the request for probation putting him on indefinite suspension. The Supreme Court then denied Holmes request for suspension and ordered that he be disbarred, stating that Holmes has had extensive contact with the disciplinary board resulting in six informal admonishments from 1988 to 2010 for complaints involving competence, fees, and lack of communication with clients.
