HUTCHINSON, Kan. — Make it four continuances now for a man awaiting sentencing on two charges which include burglary and aggravated battery.

Derrick Scaife entered a plea back in February to a reduced charge of burglary and aggravated battery with a deadly weapon and the sentencing has been scheduled four times with the latest coming Friday morning.

Amado Martinez was allegedly stabbed by Scaife after an altercation at a west side Hutchinson home. He was taken by EMS to Hutchinson Regional Medical Center for treatment. Martinez is the boyfriend of Scaife’s ex-wife and he apparently left after the stabbing. He went to McPherson where he was arrested later that day.

Defense Attorney Steve Osburn made the request stating that he has two motions he has prepared including a motion to withdraw the plea. The state opposed a continuance, but Judge Trish Rose rescheduled the sentencing until June 17. She says she will also schedule a hearing to hear the motion to withdraw the plea. If that’s allowed, the charges would go back to being aggravated burglary and aggravated battery.

Scaife remains free on a $38,000 bond.
